A special agreement within the framework of the Berne Convention, which deals with the protection of works and the rights of their authors in the digital environment. By September 2020, there are 179 states that are parties to the Bern Convention. These include 176 UN member states, as well as the Cook Islands, the Holy See and Niue. It can also specify or specify the provisions of the agreement. The Berne Convention should be reviewed regularly to keep pace with social and technological developments. It was revised seven times between its first iteration (1886) and 1971, but has not undergone any substantive revision since.  This means that its rules were adopted before the widespread adoption of digital technologies and the internet. This long drought between revisions is largely due to the fact that the Treaty gives each Member State the right to veto any substantial change. The large number of signatory countries and their very different levels of development make it extremely difficult to update the agreement to better reflect the realities of the digital world.  In 2018, Professor Sam Ricketson argued that “you dream” if you think a new revision will ever be realistic.  A 2003 agreement relaxed domestic market requirements and allowed developing countries to export to other countries with national health problems until drug exports are part of a trade or industrial policy.  Drugs exported under such regulations may be packaged or coloured differently to prevent them from affecting the markets of industrialized countries.
The 2002 Doha Declaration confirmed that the TRIPS agreement should not prevent members from taking the necessary steps to protect public health. Despite this recognition, less developed countries have argued that flexible TRIPS provisions, such as mandatory licensing, are almost impossible to obtain. The least developed countries, in particular, have made their young domestic manufacturing and technological industries proof of the infallible policy. With the TRIPS agreement, intellectual property rights have been integrated into the multilateral trading system for the first time and remains the most comprehensive multilateral IP agreement to date. In 2001, developing countries, fearing that developed countries had insisted on too narrow a reading of the TRIPS trip, launched a series of discussions that culminated in the Doha Declaration. The Doha Declaration is a WTO DECLARATION that clarifies the scope of the TRIPS agreement, which states, for example, that TRIPS can and should be interpreted in light of the objective of “promoting access to medicines for all”. The TRIPS agreement is part of the only obligation arising from the Uruguay Round negotiations. This means that the TRIPS agreement applies to all WTO members. It also means that the provisions of the agreement are subject to the WTO`s integrated dispute settlement mechanism, which is contained in the Dispute Settlement Rules and Procedures Agreement. Articles 3, 4 and 5 contain the basic rules on the treatment of foreigners by nationals and the most advantaged, which are common to all categories of intellectual property covered by the agreement.
